These Terms of Use ("Terms") govern your access to the ArcadeOn Engine website at https://arcadeonengine.app (the "Site") and any pre-release build of the ArcadeOn Engine 2.0 desktop application made available to you (the "Engine"). Together, the Site and the Engine are the "Services". The Services are operated by ArcadeOn Studios ("ArcadeOn", "we", "us").
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Alpha status
The Engine is currently distributed as a pre-release 2.0 Alpha. The Alpha is provided for evaluation and feedback. Features may change, break, or be removed without notice. The Alpha is not intended for production use, and we do not currently offer paid plans, user accounts, sign-in, subscriptions, or refunds.
Eligibility
You must be at least 13 years old to use the Services. By using the Services, you confirm that you meet this age requirement.
Licence to use the Engine
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and run the Engine on machines you own or control, for the purpose of evaluating it, learning it, and creating games with it during the Alpha.
You may not:
- Redistribute, sell, sublicense, rent, or lease the Engine.
- Reverse-engineer, decompile, or disassemble the Engine except to the extent expressly permitted by applicable law.
- Remove or alter any proprietary notices in the Engine or its bundled assets.
- Use the Engine to build, train, or evaluate competing AI / engine products.
Your projects and content
- You retain all ownership of the game projects, scenes, code, art, audio, and other content you create using the Engine ("Your Content").
- We claim no licence in Your Content beyond what is needed to provide a feature you explicitly use (for example, sending us a diagnostics bundle from the in-editor Support panel).
- You are responsible for ensuring you have all necessary rights and permissions to use third-party assets you include in Your Content (sprites, audio, fonts, plugins, etc.).
Bundled third-party software
The Engine includes third-party software listed in the bundled NOTICES.txt, including MonoGame (Ms-PL), Dear ImGui (MIT), Inter font (SIL OFL), JetBrains Mono (Apache 2.0), and others. Your use of those components is also subject to their respective licences.
Acceptable use of the Site
When using the Site, you agree not to:
- Attempt to bypass security or rate limits, or scrape the Site at a rate that could degrade it for others.
- Upload malware or otherwise interfere with the Site's normal operation.
- Use the Site for illegal, harmful, or abusive purposes.
Availability and changes
We may update, suspend, or discontinue any part of the Services at any time. The Alpha may be updated automatically through the in-editor AutoUpdater. We may also update these Terms; the "Last updated" date at the top of this page tells you when.
Termination
You may stop using the Services at any time by uninstalling the Engine and ceasing to visit the Site. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law.
Disclaimer of warranties
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that the Engine will be free from bugs, since by definition this is a pre-release Alpha.
Limitation of liability
To the maximum extent permitted by law, ArcadeOn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or game projects, arising out of or in connection with the Services. Our aggregate liability for any claim arising out of these Terms is limited to £100.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited (for example, liability for death or personal injury caused by negligence, or for fraud).
Privacy
Your use of the Services is also governed by our Privacy Policy and Cookie Policy.
Governing law
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms will be resolved in the courts of England and Wales.
